Britain's prison population is expected to rise above the critical
80,000 mark within the next few days meaning that the country's
prisons will be official full to capacity.
Home Secretary John Reid is facing some stark choices to deal with the
crisis as he considers whether to open moth-balled police stations,
deploy disused ferries as floating jails or order the early release of
some prisoners.
Another option would be to repatriate some of the 11,000 foreign
prisoners to their country of origin. About 2,000 are EU nationals and
deals are being discussed which would see a prisoner exchange scheme
where the EU nationals in British prisons are swapped for the 800
British nationals in EU jails, thus theoretically releasing some 1,200
places.
Cost to taxpayers
But such a plan hinges on stripping the 11,000 foreign prisoners
currently here of the right to block their transfer back home.
The Government has agreements with more than 100 countries who are
willing to take back criminals so they can serve their sentence in
their homeland. But the convict can object and insist he serves his
time at UK taxpayers' expense. The criminal is then free to fight
deportation once his sentence is complete.
Yesterday, Mr. Reid tabled amendments to the Police and Justice Bill
which will remove the need for the criminal to give consent.
However ministers are likely to be held back by their commitment to
human rights. China and Iran are among the nations at the top of the
list of overseas nationals in our jails, but Britain is not allowed to
send inmates back to these countries in case they are tortured.

Three of the most serious offenders who were released from prison
before being considered for deportation remain at large, the Home
Office has said.
The government came under fire after it emerged more than 1,000 foreign
prisoners were released without being considered for deportation.
In the wake of the scandal, Home Secretary John Reid said his
department was not fit for purpose.
Sex offenders, violent criminals and killers were among those released.
Speaking to MPs, the home secretary announced several initiatives
including funding of up to ВЈ2,500 when foreign inmates agree to be
repatriated.
