When one has sex with one's wife without her knowing - is it consider
rape since she was not given the opportunity to consent?

MADISON, Wis. - Police who videotaped a man having sex with his
comatose wife in her nursing home room violated his constitutional
rights, an appeals court ruled Thursday.

David W. Johnson, 59, had an expectation to privacy when he visited
his wife, a stroke victim, at Divine Savior Nursing Home in Portage,
the District 4 Court of Appeals ruled. Therefore, police violated his
Fourth Amendment rights against unreasonable searches when they
installed a hidden video camera in the room, the court said.

not only this case is having such a story to it, but there were many
mhong cases that the husbands were only sleeping with his own legally
wife...and then she turned against him that he had raped her. the laws
would threw the husband in jail. there was a famous case in Oshkosh
long ago, about the consent of the wife before he can have sex with
her.

sad huh...vimhlub and nhubkaj...LOL!

I believe the case should be looked at in a broader context. I'm sure
you've heard of the case where a comatosed woman got pregant in a
nursing home and delivered her baby without ever waking up from her
coma. The husband had nothing to do with it. Someone in the nursing
home raped her. The law tries to protect people from many angles and
sometimes each individual case just simply fall through the crack such
as this case.

Nhubkaj...and Zhen,

i agree with you to certain extend, except that in this case, it was
involved with the husband himself...and the system was willing to put
the husband and his wife on the financial burden of the family to be
drained, such that this is his own legally marriage wife. the only
thing we wanted you to understand is that when it involved with
husband and wife, the system should have ease the tension, instead of
not only ruining their marriage, but their financia
--such that there
is no remedy of the cost from the public system on how much they had
gone through (humiliation, times, and money).

Common law states that when one gets married, one willingly consents
to having sex with the one to whom one is married. Because of the
feminist movement, such law is now only a distant memory. Instead,
every intercourse between husband and wife must now have consent
(mostly from the wife). The feminists believe that in doing this,
women will have some say in this male dominated world because they are
now the gatekeepers to men's natural desires. Although many true
women see that the feminists have gone too far, they, like most men,
did not think it's worth the effort to speak against things that are
unnatural.

Hnub,

I think the reason why the case here is a no go is because it is
clearly wrong. I do not see why the law should criminalize
intercourse between husband and wife. Should we look at this in a
broader context? NO. Good laws should only punish those who do
wrong. When laws punish both wrongdoers and rightdoers, the law is
bad and needs to be abolished. No second angle needs to be look at.
If these kinds of prosecution continues, pretty soon everyone is going
to require a court order in order to sleep with ones spouse.

Pardon me before I speak.

There was a question as to where the word F.U.C.K came from. Some
have thought that long ago, the King of England decreed that anyone
who wants to fornicate had to get the King's consent. If anyone does
it without his consent, he would be beheaded. So, in order to avoid
confusion, people would post the sign "Fornicating Under Consent of
the King" at their hut before they take part in the act. As time with
on, people reduced the wordings to "F.U.C.K" to make the sign shorter
and to avoid embarassment.

With the way the laws are going now, soon we will have to post such
signs on our bedroom doors.
