I am the Committee Chair and the other night a scout brought four of
his Eagle requirement merit badges and his project completion to be
signed off. This meeting was 48 hours before his 18th birthday.

The C. in Nation and E. Prep merit badges were partials where he
lacked one requirement. The other two, Family Life and Personal
Mangement had never been reviewed before.

For Family Life he had done cleaning around the house for his project.
The merit badge counselor thought there needed to be more thought and
would like to have pre-approved the project. There had been no
discussion with this boy from the time he started until this night. He
was told to do a different family project and contact the counselor
again.

For Personnel Management he used the forms from MeritBadge.Org and
filled them out and brought them in as his proof of completion. I had
the papers review by two merit badge counselor for the badge and
neither one would sign off on the badge without several meetings. Both
thought he needed to redo his 90 day budget.

So he was batting .500 on the merit badges with 48 hours left. We
didn't sign off on the project because neither the Scoutmaster or
myself had seen the work yet.

Here is where it gets interesting -- he calls another Troop, gets with
their merit badge counselor and gets them to sign a blue card for
Personnel Management. He comes to my house with the blue card (no
Scoutmaster signature), and his Family Life with a different project
from 5 months ago. He wants me to take his blue card, approve this
Family Life and sign his application. I called the Scoutmaster and the
three of us met for over two hours.

At the end of time we had not approved either merit badge, and not
signed his application. He has now turned 18 and Mom is raising the
roof. I can't lower standards just because the boy is 17.999 years
old.

What happens on a appeal when there are merit badges and issues other
than just the approvals on the application? I would like the boy to
get Eagle, but I don't want to have the other Scouts feel that rules
have been bent. My feeling at this point is that there is no wiggle
room in not completing merit badges before you are 18.

He says that no "reasonable" or "normal"
person would regard a DtG oath is an
infringement of religious liberty, and thus
says that there is "no issue" over DtG
oaths, which are "not a problem".

However, exactly this point was the central
issue of the Supreme Court case Torcaso
v Watkins (1961) in which the Court ruled
9 to 0 against Stan's stance.

For those interested, the issue was over the
Mayland State Constitution which said "No
religious test ought ever to be required as
a qualification for any office of profit or
trust in this State, other than a declaration
of belief in the existence of God . . . .".

[Hmmm, much like Stan's stance over religion
in BSA.]

Torcaso was appointed to public office in
Maryland, but refused to declare a belief
in God, and so was dismissed. The case
went all the way to the Supreme Court.

Those supporting Torcaso's dismissal from
office claimed that no breach of religious
freedom had occurred because they
considered that Torcaso was effectively
choosing not to take public office: "True,
unless he makes the declaration of belief,
he cannot hold public office in Maryland,
but he is not compelled to hold office."

[Hmmm, much like Stan's claim that anyone
who won't submit to BSA's religious test
is not being discriminated against, but is
merely choosing not to join.]

The Supreme Court had a good laugh at
this claim, and then dismissed it, saying
"The fact, however, that a person is not
compelled to hold public office cannot
possibly be an excuse for barring him
. . . by . . . criteria forbidden by the
Constitution."

[Which, surely implies also: "the fact
that a person is not compelled to
participate in a publically funded
program cannot possibly be an
excuse for barring him by criteria
forbidden by the Constitution"]

Further, the Court held that requiring a
declaration of belief in God was indeed
a religious issue, and thus an infringement
of freedom of religion. Indeed, they
regarded it as so bleeding obvious that
they didn't discuss it much. They
simply said:

"This Maryland religious test for public office
[namely, the requirement to declare belief in
God] unconstitutionally invades the appellant's
freedom of belief and religion and therefore
cannot be enforced against him."

They made this ruling on the First Amendment,
making it entirely clear that requiring
declarations or oaths regarding God was
contrary to the First Amendment, and thus
could not be done where public office or
public money were concerned.

And note that they didn't get sidetracked
into considerations of what is or isn't
already present in the nation's culture
and heritage, blah, blah, blah -- that is
utterly irrelevant since the whole point
of the First Amendment is that minorites
are under no obligation to assent to the
religious ideas of the majority.

So that's it, clear as day, according to
a 9--0 ruling of the Supreme Court.

"Held: This Maryland test for public office
["a declaration of belief in the existence
of God"] cannot be enforced against
appellant, because it unconstitutionally
invades his freedom of belief and

Thus, BSA cannot receive public money
