The unlawful combatant/detainee law recently passed by Congress was
flawed on several constitutional points.
It is an ex post facto law -- it applies to people already arrested.
That is forbidden in the Constitution.
It also flagrantly violates the 4th, 6th and 14th amendments.
It also makes a complete mockery of the progress we've made as a nation
on civil liberties.
President Lincoln wrote:
"It forces us to ask: 'Is there, in all republics, this inherent and
fatal weakness?' 'Must a government, of necessity, be too strong for
the liberties of its own people, or too weak to maintain its own
existence?'"
The United States has now failed the test.
