Gulf Air fined for breaching curfew

Missing the clock by a few minutes has cost Gulf Air a record $167,500
in fines for breaching Sydney Airport's curfew on incoming and
outgoing flights past 11pm.
"There are real and genuine victims: those persons who are trying to
sleep or otherwise enjoy some respite," The Magistrate who decided the
verdict, David Heilpern, said in Downing Centre Local Court as
reported in the Sydney Morning Herald yesterday.
The hefty fine was for two breaches of the curfew, which Mr Helipern
said the airline crews chose to breach despite being refused the
dispensation required under law and being warned of the penalty's
involved.
It was reported that on each occasion it was the crew's decision and
not that of the air traffic controllers', with both incidents taking
place in 2005 the first at 11.14pm and the second on 11.28pm.
Departures of both flights were delayed due to mechanical repairs.

To 'depart' SYDNEY around curfew time, you need to have your 'taxi
clearance' before 11pm!
If you receive a 'taxi clearance'before 11pm, you can then taxi at your
leisure and depart after 11pm.
The only proviso is you depart off Runway 16R. No departures off Runway 34L
after 10:45pm!

Wouldn't that be an 'airways clearance'? Isn't there a time limit to
comply with a taxi clearance?

No, it is once the taxi clearance is received.

Pilots are obligated to maintain a listening watch on frequency once the
clearance is received but, like you said, they are also expected to action
the instruction within a specific timeframe - which I can't find reference
to in the AIP. I'll have a look in the Jepps when I get home!
