it's not clear that she caused the accident in question.

the other person left the scene of the accident,

which is generally frowned upon.

prior behavior is not relevant.

driver A is travellng along the road,

driver B begins to make a U-turn

driver A swerves to avoid driver B

driver A clips the bumper of driver B
and spins out flipping several times while
a passeneger of driver A is ejected from the
automobile landing on the ground.

driver B watches this tumbling car
and must see the passenger ejected,

and then, decides to leave the scene offering
no assistance to the ejected passenger or
even notifying the police.

for one thing, this is just cold blooded.

one last little bit;

it would be considered a negligence
for driver A to not have all
passengers in seat belts,

and/but they are dumping the entire truckload,
including =driver A's= negligence onto driver B
-because- driver B left the scene of
the fatal accident.

sight unseen...

all the prosecuters see is a stack of paper

and driver B is described as;

"driver B, left scene of fatal accident"

not;

"driver B, visitor from alien planet
with whom we have poor relations"

and when they see that,

then they proceed to dump everything

on driver B.

in part because, when they see that,

that becomes "the crime"

where leaving the scene outweighs impairment

especially inasmuch as both drivers
could be described as impaired.
