Actually, Breyer (among others) nearly claim the contrary. The whole
"living constitution" theory is a fig leaf for rewriting according to
what one feels about the law.

Scalia, surprisingly enough, has often sided with the nominally left
side of the court, notably in cases concerning free speech and freedom
from illegal search and seizure.
