The only way you can argue a hate crime based on a disability is if
you admit you have mental illness, at which point anyone you're
accusing has the right to demand a mental examination - because if you
don't have a mental illness, there was no crime - which means now,
there are grounds to file a petition against you.

So please, go ahead and file your criminal complaint. It would have
to be proven you're mentally ill, which then is all that is necessary
to file for your commitment. If you are determined to be mentally
ill, it is arguable with what you have said that you may be considered
a danger possibly to yourself or others.
