Ask the US Supreme Court. That's where the case is. If they don't hear the
case, the same lawsuit would probably win in Illinois. Just going to the
Supreme Court first to give them a chance to standardize the law. If they
refuse that chance, then Illniois becomes the one place in this country
where people can sue ISPs for what their users do.
So, to answer your question, the lawsuit is doing what it is supposed to.

As if she were there for my childhood, spent living in a place she could
