I am getting a little tired of waiting for Gordon to sue me, or
someone else, which doesn't involve a lot of corporate BS. The issue
is one of libel per quod, so I had coffee this morning with an old
friend that is an attorney to discuss filing here in California. What
was interesting was the following two questions he asked me after
firing up the laptop and about 15 minutes with Google:
1. "Vance, do you realistically think this nut case can harm your
personal or professional reputation?"
The answer was "No. Not meaningfully."
2. "What do you think the Court will say?"
The answer was "That I couldn't show damages because no one would
reasonably rely on his statements in making a character judgment, nor
give his comments any weight in deciding to hire me as a
photographer. And they would probably say that nothing that goes on
in ASF reasonably impinges on my life now, or in the future regarding
statements made there."
His response: "Bingo!"
I pretty much suspected that already, but I wanted to be sure.
Besides, I hadn't seen him in a couple of years and it was good to BS
for a bit. Besides, it only cost me two cups of coffee and doing a
headshot for his display ad in the next Directory. However, joining a
suit as a defendant is very viable.
Damn, Gordon! I can't sue you because nobody in their right mind
would pay attention to what you say. You go Girl!
