CHARLOTTE, Tenn. - A juvenile court judge said the state Department of
Children's Services could be to blame in the slayings of a foster mother
and her mother-in-law because of the way it places troubled children in
its care.

Foster children James Earl Garrett, 17, and Jeffery Byrd Johnson Jr.,
15, are charged with first-degree murder in the New Year's Day deaths.

Judge Andrew Jackson pointed the finger at DCS after a hearing Friday
where he ordered the boys held in custody until he can decide whether
they will be tried as adults.

"If the facts of the case are true, as they appear to be, the blame
rests squarely at the front door of the Tennessee Department of
Children's Services," the judge told reporters.

COLUMBUS – Attorneys argued before the Ohio Supreme Court todayTuesday
whether the names and addresses of foster care parents should be public
record.

John C. Greiner, a Cincinnati lawyer representing the Enquirer, said,
“We are not asking for the names of any children.”

Enquirer reporter Gregory Korte made a public records request shortly
after the August 2006 death of 3-year-old Marcus Fiesel, seeking an
electronic database of all foster homes in Ohio.

Marcus died after his foster parents left him tied up in a closet while
they took a weekend trip to Kentucky. Liz and David Carroll Jr. were
later convicted in the boy’s murder.

The Enquirer reported in March that Hamilton County court officials
discovered 27 foster parents had arrest records.

what it could to protect a 12-year-old Phoenix girl murdered last month,
the agency has provided information that clearly, unequivocally shows . . .

Nothing.

Once again, mum's the word over at the agency that poses the last thin
line of defense for children in this state. The law, it seems, won't
allow full disclosure of the state's involvement with a girl who was
burned and then beaten to death and left for days in a tiny apartment
with her traumatized little sister.

Ann Unger set her 9-month-old daughter on the floor of the family's
Plant City home and headed to the bathroom. Angelica, a fast crawler,
usually followed close behind. Not this day.

Five minutes passed. Or was it six?

When Unger, 22, returned to the room, Angelica wasn't there. A frantic
search ended in the backyard pool, where Unger found the child floating
face down.

The mother's screams pierced the neighborhood as efforts to save the
baby failed. Angelica Unger died on Jan. 24, 2006, three months before
her first birthday.

In the past, her death likely would have been considered accidental, a
family tragedy. But investigators labeled her death a result of parental
neglect. Unger had left open the door that led to the pool.
