Using age as a criteria is obviously age discrimination by definition. descrimination in this meaning is *unreasonable* use of the criterion. That depends... If the policy is a "whole life" policy, and has a "cash value", then the insurance will be considered a "family asset". This then becomes a discussion for the courts.
