I read it as, "the OP should have written to the Council, after the incident but before paying for a solicitor's letter". I am surprised that, during the free half-hour consultation that I thought most (all?) solicitors offer, he didn't suggest writing it off to experience. After all, the tree cannot be returned to its original condition. Clearly council workmen don't go driving about
