You're both wrong. It's about socially acceptable behavior and what is tolerated on private property. I can't have someone arrested for saying something offensive in my home, but I sure have the right to ask them to leave. That's not open to the public, you say? Okay, then, let's take something comparable like a motel. It is private property, but is used by the public on a fee basis.
