Bruce Back when the FF were writing the Constitution, lots of crimes were adjudicated by use of the whipping post! That punishment has been deemed unconstitutional as cruel, and unusual, in today's more enlightened times! Considering that in most cases, the death penalty takes years to carry out, would seem to make it an "unusual" punishment, wouldn't you say? I'm not even mentioning
